Terms of Service

Qouva is an online classifieds marketplace that connects buyers and sellers. Qouva provides the venue where users post listings, communicate, and arrange transactions. Qouva is not the buyer or seller of any item listed by users, is not a party to any transaction between users, and does not take possession of, inspect, or guarantee any item or service offered on the Platform.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Platform. By using Qouva you represent that you meet this requirement and that all information you provide is accurate and current. You are responsible for complying with all laws that apply to you.

• You must register an account and verify your contact details (including your phone number) to access certain features such as posting ads and messaging.
• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
• You agree to provide accurate registration information and to keep it up to date.
• Notify us immediately of any unauthorised use of your account.

When you post an ad you are solely responsible for its content, accuracy, and legality. You agree that every listing will:

• Describe a real item or service that you are entitled to sell or offer.
• Be placed in the correct category with accurate details, pricing, photos, and location.
• Not be duplicated, misleading, or used to redirect users off the Platform to avoid fees or safety measures.

We may review, decline, edit the placement of, pause, or remove any listing that breaches these Terms or our policies, with or without notice.

You may not list, sell, or promote anything that is illegal, unsafe, or restricted, and you may not misuse the Platform. Prohibited activity includes, without limitation:

• Weapons, illegal drugs, counterfeit or stolen goods, endangered wildlife, and other items prohibited by law.
• Adult or sexual services, human trafficking, or any exploitation of minors.
• Fraud, scams, deceptive pricing, pyramid or "get rich quick" schemes.
• Posting another person's contact details, harassing, threatening, or abusing other users.
• Spam, malware, scraping, or any attempt to disrupt, overload, or gain unauthorised access to the Platform.
• Sharing contact information inside listing text to circumvent our messaging or safety tools.

Transactions are agreed directly between buyers and sellers. Qouva does not verify the identity of users beyond the checks we describe, does not guarantee that a buyer or seller will complete a transaction, and is not responsible for the quality, safety, legality, or delivery of any item or service. You are responsible for exercising your own judgement, meeting in safe locations, and confirming goods before paying. We strongly encourage you to follow our safety guidance.

• Posting basic ads is free. Optional paid plans and promotions unlock additional features, limits, and reach.
• Prices, plan features, and limits are shown on the pricing page and may change from time to time.
• Payments are processed by our third-party payment provider. By paying you authorise the applicable charge and agree to the provider's terms.
• Unless required by law or stated otherwise, fees for plans and promotions are non-refundable once the benefit has started.

Paid boosts increase the visibility of a listing for a set period. Boosts affect ranking only; they do not guarantee sales, views, or any specific outcome. A boost applies to the specific listing it was purchased for and ends automatically when its period expires.

Reviews must reflect genuine experiences. You may not post fake, incentivised, or retaliatory reviews, and you may not manipulate ratings. We may remove reviews that breach these Terms, and sellers may dispute or, where their plan allows, manage reviews subject to our policies.

You retain ownership of the content you post. By posting content you grant Qouva a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and distribute that content for the purpose of operating, promoting, and improving the Platform. You represent that you have the rights necessary to grant this licence and that your content does not infringe the rights of any third party.

The Platform, including its software, design, logos, and trademarks, is owned by Qouva or its licensors and is protected by law. You may not copy, modify, distribute, or create derivative works from any part of the Platform except as expressly permitted.

The Platform may link to or rely on third-party services (such as payment, messaging, or mapping providers). We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their own terms.

We may suspend, restrict, or terminate your access to the Platform at any time if you breach these Terms, create risk or legal exposure for us or other users, or for any other legitimate reason. You may stop using the Platform and close your account at any time. Provisions that by their nature should survive termination will continue to apply.

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that listings, users, or transactions are accurate, lawful, or reliable.

To the fullest extent permitted by law, Qouva and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for disputes between users, arising from your use of the Platform. Where liability cannot be excluded, it is limited to the amount you paid to Qouva in the twelve months before the event giving rise to the claim.

You agree to indemnify and hold Qouva harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Platform, your transactions with other users, or your breach of these Terms or any law.

We may update these Terms from time to time. When we make material changes we will update the effective date and, where appropriate, provide additional notice. Your continued use of the Platform after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of Nigeria for any dispute that is not resolved informally.
